SunSirs: China-EU Electric Vehicle Trade Case Lands Softly as EU Prepares Price Commitment Framework

The Ministry of Commerce issued a notice on the progress of consultations on the China-EU electric vehicle case on the 12th. According to the notice, the European side will release the "Guidelines on Submitting Price Undertaking Applications". Industry insiders pointed out that this means that after multiple rounds of consultations, the case has achieved a "soft landing".

The circular pointed out that in order to implement the consensus reached at the China-EU leaders' meeting and properly resolve the EU's case against Chinese electric vehicles, China and the EU have conducted multiple rounds of consultations with an attitude of mutual respect. Both sides agreed that it is necessary to provide general guidance on price commitments to Chinese exporters that export pure electric vehicles to the EU, so that Chinese exporters can address relevant concerns in a more practical, targeted manner that is in line with WTO rules.

To this end, the European side will issue the "Guidance Document on Submitting Price Undertaking Applications" and confirm in the document that it will adhere to the principle of non-discrimination. In accordance with the relevant provisions of WTO rules, it will apply the same legal standards to each price undertaking application and conduct evaluations in an objective and fair manner.

A responsible person from the China Chamber of Commerce for Import and Export of Machinery and Electronic Products stated that Chinese electric vehicle enterprises can submit applications for price commitments in accordance with the contents of the guiding documents. The European Commission has promised that it will, in line with the principle of non-discrimination, conduct objective and fair reviews of applications submitted by Chinese enterprises using uniform standards, and eligible enterprises can use price commitments to replace anti-subsidy taxes.

The circular stated that this fully reflects the spirit of dialogue and the results of consultations between China and the EU. Both China and the EU have the ability and willingness to properly resolve differences through dialogue and consultations within the framework of WTO rules, and maintain the stability of the China-EU and global automotive industrial chains and supply chains. This is not only conducive to the healthy development of China-EU economic and trade relations, but also to maintaining the rules-based international trade order.

The China Chamber of Commerce for Import and Export of Machinery and Electronic Products believes that a proper resolution of the EU's anti-subsidy case against Chinese electric vehicles is the common expectation of the entire industrial chain of electric vehicles in both China and the EU. It will help promote the safety and stability of relevant industrial and supply chains between China and the EU, safeguard the overall situation of China-EU economic and trade cooperation, and maintain the rules-based international trade order. Adhering to the spirit of mutual respect and dialogue, China and the EU have successfully promoted a "soft landing" of the case through multiple rounds of consultations.
