【Ministry of Commerce Announces Decision to Implement Export Controls on Rare Earth-Related Technologies】On October 9, the Ministry of Commerce announced that, with the approval of the State Council, it has decided to implement export controls on certain items, including rare earth-related technologies. The following items shall not be exported without permission:

(1)Technologies and their carriers related to the extraction, smelting and separation, metal smelting, magnetic material manufacturing, and recycling of rare earth secondary resources; (Control Code: 1E902.a)

(2)Technologies related to the installation, commissioning, maintenance, repair, and upgrading of production lines for the extraction, smelting and separation, metal smelting, magnetic material manufacturing, and recycling of rare earth secondary resources. (Control Code: 1E902.b)

If non-controlled goods, technologies, or services are exported, and the exporter knows that they will be used or substantially assist in the extraction, smelting and separation, metal smelting, magnetic material manufacturing, and recycling of rare earth activities overseas, they shall, in accordance with Article 12 of the "Export Control Law of the People's Republic of China" and Article 14 of the "Regulations on the Export Control of Dual-Use Items of the People's Republic of China," apply for a dual-use items export license from the Ministry of Commerce before export. Such items shall not be provided without permission.
