SunSirs: Chinese Government Issues: Interim Measures for the Total Control and Administration of Rare Earth Mining and Smelting and Separation

On August 22, the Ministry of Industry and Information Technology and two other departments issued the Interim Measures for the Total Control Management of Rare Earth Mining and Rare Earth Smelting and Separation, which mentioned that rare earth mining enterprises should strictly comply with laws, administrative regulations, and national provisions, and engage in rare earth mining and rare earth smelting and separation within the total control indicators. The determination of rare earth mining enterprises shall be carried out by the Ministry of Industry and Information Technology in conjunction with the Ministry of Natural Resources. Except for enterprises determined in accordance with the preceding paragraph, other organizations and individuals shall not engage in rare earth mining and rare earth smelting and separation.
According to the new document, relevant state departments will set annual target quotas for rare earth element mining, smelting, and extraction and allocate these quotas to enterprises. Quota allocation will take into account the following factors:
National economic development goals;
National rare earth metal reserves and their types;
Industrial development;
Environmental protection;
Market demand.
Enterprises must mine and process rare earth ores within the approved quotas. Furthermore, enterprises must record product flow information and upload the data to an information system for tracking.
